Terms of Service

1. Acceptance

By accessing or using Data Network (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Data Network provides realtime WebSocket pub/sub infrastructure with optional message persistence, intended for use in creative, artistic, and technical projects. The Service is currently in alpha and is subject to change.

3. Acceptable Use

You agree not to use the Service to:

  • Transmit unlawful, harmful, or abusive content
  • Intentionally overload or degrade the platform for other users
  • Attempt to gain unauthorised access to any part of the infrastructure
  • Resell or redistribute access without prior written consent

4. API Keys & Credentials

You are responsible for keeping your API keys secure. Do not expose keys in public repositories or client-side code. Notify us immediately if you suspect a key has been compromised.

5. Service Availability

While we aim for high availability, the Service is provided “as is” during the alpha period. We do not guarantee uptime and may perform maintenance that temporarily interrupts the Service.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Data Network and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Service.

7. Termination

We reserve the right to suspend or terminate access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.

8. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Privacy Policy

1. Data We Collect

When you use Data Network, we collect:

  • Account information — your name and email address when you register
  • Usage data — message counts, connection events, and rate-limit incidents associated with your project
  • Message payload data — the content of messages you publish to channels with retention enabled, stored for the configured retention period only

2. How We Use Data

  • To provide and operate the Service
  • To enforce plan limits and detect abuse
  • To communicate with you about your account

We do not sell your data to third parties.

3. Data Retention

Message payloads are stored only for the retention window configured on each channel (up to 90 days). Account and usage data is retained while your account is active and for a reasonable period thereafter.

4. Third-Party Services

The Service uses infrastructure providers (hosting, database, caching) to operate. These providers process data only as necessary to deliver the Service and are bound by appropriate data-processing agreements.

5. Security

API keys are stored as salted hashes. Connections use TLS in transit. We follow industry-standard practices to protect your data, though no system is completely secure.

6. Your Rights

You may request access to, correction of, or deletion of your personal data at any time by contacting us through jordanshaw.com/contact.

7. Jurisdiction

Data Network is operated from Toronto, Ontario, Canada. These policies are governed by the laws of Ontario and the federal laws of Canada applicable therein.
